Terms of Use

These Terms of Use ("Terms") govern your use of RoseGarden ("the App"), developed by Douglas Davis ("we", "us"). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Licence

We grant you a personal, non-transferable, non-exclusive licence to use RoseGarden on Apple devices that you own or control, in accordance with Apple's App Store Terms of Service and these Terms.

2. Subscriptions (RoseGarden Premium)

• RoseGarden is free to use with certain limits (for example, free users may add up to 2 roses to their garden). "RoseGarden Premium" is an optional auto-renewable monthly subscription that unlocks unlimited garden roses, the Grow Diary, advanced tracking, and care reminders.
• Payment is charged to your Apple ID account at confirmation of purchase.
• The subscription automatically renews each month unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription at any time in your device's App Store account settings.
• The current price is shown in the App before you purchase. Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.

3. Acceptable Use

You agree not to misuse the App, attempt to reverse-engineer it, or use it in any unlawful way.

4. Plant & Health Guidance Disclaimer

RoseGarden provides general information about rose care, diseases, and treatments for informational purposes only. It is not professional horticultural, agricultural, or chemical-safety advice. Always follow product labels and local regulations when handling fertilizers, pesticides, or other treatments. We are not responsible for outcomes resulting from reliance on in-App information.

5. Intellectual Property

The App, including its design, text, and content, is owned by us and protected by applicable laws. Content you create remains yours.

6. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law.

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

8. Governing Law

These Terms are governed by the laws of the Republic of South Africa, without regard to its conflict-of-law rules.

9. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised "Last updated" date.
